Fair Share Law Passed in Pennsylvania

Governor Corbett signed into legislation the Pennsylvania “Fair Share Law” which took effect on Tuesday, June 28, 2011.  The law replaces joint defendant liability in many cases, changing Pennsylvania’s doctrine of joint and several liability so that  a defendant that is found less than 60% liable will only be responsible for its proportionate share of the total verdict.  The Act also contains exceptions permitting joint liability to continue to be imposed for intentional misrepresentations, intentional torts, certain environmental contamination claims, and certain violations of the Liquor Code.
