Update on the Medicare, Medicaid and SCHIP Extension Act of 2007 (MMSEA)

Update on the Medicare Secondary Payer (MSP) Mandatory Reporting Provisions in Section 111 of the Medicare, Medicaid and SCHIP Extension Act of 2007 (MMSEA), (See 42 U.S.C. 1395y(b)(7)&(b)(8))

The Centers for Medicare & Medicaid Services (CMS), in efforts to assist the reporting requirement for Responsible Reporting Entities (RRE), established a webpage dedicated to the Section 111 reporting for liability insurance (including self insureds), no-fault insurance and workers' compensation (CMS often refers to these as NHGP or Non-GHP for Non-Group Health Plans).

The webpage: www.cms.hhs.gov/MandatoryInsRep  allows visitors to sign up for an automatic update service.  Official instructions appear at this webpage and can be downloaded as necessary.  The Tabs at this webpage include an Overview which allows the user to access information and documents relevant to Group Health Plans or Non-GHP's as noted above and either print or download these documents.

Of particular importance, this site includes a Liability Insurance/No-Fault Insurance/Workers' Compensation Tab with information specific to these groups including the User Guide dated March 16, 2009, and subsequent alerts supplementing the User Guide. This User Guide has detailed information about all aspects of the reporting process including registration, record layout and details on who precisely is an RRE, Responsible Reporting Entity, and when they are to report.  This was referred to by one of Medicare's Health Insurance Specialists as "The Bible" of Medicare Secondary Payer Reporting.

If you believe you are an RRE, registration is suggested by September 30, 2009, although you will be permitted to register thereafter.  Registering at your earliest convenience will allow for the receipt of the automatic updates keeping you apprised of the latest developments.
