Congratulations to John McNally
John J. McNally has been Appointed by Governor Corbett to the Pennsylvania Workforce Investment Board (“PA WIB”). This Board is the Governor's principal private-sector policy advisor on building a strong workforce development system aligned with state education policies and economic development goals. John will, of course, continue his work with TT&H as he assists the Governor and Commonwealth citizens in this new appointment. Congratulations John!

New Year's Resolution
The New Year is the perfect time to revisit claims handling procedures to ensure guidelines are being followed and “best practices” are being met.
After celebrating the holidays and remembering the successes of the past year, we can begin to look forward to the new year, and the new challenges and opportunities it presents. To strive for continued success, revisit your policies and procedures regarding claim documentation fair claims practices. Good reasons for doing so include: better claims handling, better performance reviews, and better protection from bad faith liability. This advisory is not intended to provide an exhaustive checklist; rather it contains suggestions for evaluating and re-visiting your “best practices.”
The best place to start is your claims handling manual. It is important that your claims adjusters review and understand the mandates and guidelines contained in the manual and that they follow them. Given that in bad faith litigation, these manuals are typically discoverable, establishing that your claims adjusters followed the dictates of the manual goes a long way in mitigating liability.
Key to an adjuster’s success in claims handling is documentation with the “whos, whats, when, wheres, and whys”. Improperly documented files can have a detrimental effect on claim resolution. Further, it should be no surprise that the claims file (and all the claim notes) is ordinarily discoverable in a bad faith action. Well-documented claims files that indicate that the company’s claims handling guidelines were followed is enormously helpful when defending a bad faith claim.
Proper claims handling and documentation is an on-going process, and there is always room for a “refresher,” and improvement. It is an involved, ever-evolving process, and cannot be summed up in a single advisory. If you have any questions about claims handling procedures, or “fine-tuning” your current guidelines, we would welcome the opportunity to assist you.

TT&H LAWYERS SPEAKING OUT
Thomas P. McGinnis, of the Pittsburgh office, was recently Program Chair for the Academy of Trial Lawyers of Allegheny County’s 23rd annual Federal Practice Program entitled “Helpful Hints about Practice in the Federal Courts”. Attorney McGinnis also acted as co-moderator for a Judges’ roundtable held during the program.
On December 15, 2011, Brooks Foland and Kevin McNamara were panel members for the Pennsylvania Bar Institute’s 18th Annual Automobile Update, held live in Mechanicsburg, PA and telecast to Philadelphia and Pittsburgh. Kevin McNamara spoke on “Life after Koken”. Brooks Foland spoke on “The Importance of Acting Immediately upon Receipt of a New Case Assignment” (See below regarding “New Years Resolution”).

On December 3, 2011, Hugh P. O’Neill, III was a guest lecturer at the Dauphin County Medical Society conference held at Harrisburg Area Community College. His topic addressed issues surrounding tort reform in the medical field, including an update on malpractice issues.

John McNally, our Partner in the Harrisburg office, announced earlier this month his intention to run for the State Senate (15th District). This seat is being vacated by Senator Jeff Piccola at the end of 2012 after many years of honorable service. John is running for State Senate so he can continue fighting for working families and small businesses. He will work to create jobs, change the culture of the capitol, and protect South Central Pennsylvania values.
