Non Suit in Favor of Defendant in Liability Case

Joseph A. Holko successfully moved for non suit after Plaintiff and Defendants rested their case in chief following seven days of trial.

Plaintiff, while working as a volunteer at his Church during renovations, was injured when a sheet of drywall fell on him, pinning him for several hours. Plaintiff's left leg required above the knee amputation. Plaintiff also suffered torn ligaments in his right knee.

Representing the Church, Attorney Holko argued that the site was controlled by an independent contractor who was responsible for safety at the time of the accident and that the Church breached no duty to the plaintiff. The Court agreed and granted the Church's motion for non suit. The jury later returned a verdict in favor of Plaintiff against the remaining defendants in the amount of $4.4 million.
