Defense Verdict Issued in Medical Malpractice Case

Daniel L. Grill (Harrisburg) recently obtained a defense verdict on behalf of his client. The case was tried the week of August 28, 2006 before The Honorable Jeffrey L. Schmehl and a jury of twelve in Reading, Berks County, Pennsylvania.

TT&H represented a Reading area neurosurgeon who performed a lumbar anterior fusion back in 1999. Plaintiff developed diffuse bleeding and ripped his incision and spent six days on a ventilator and had a total hospital stay of three weeks.

Throughout the years the Plaintiff developed nine abdominal hernias at the incision site as well as suffered from respiratory problems and continued back and leg pain.

During cross examination, Plaintiff's expert agreed with the defense position that informed consent did exist.
