Attorney Matthew Hutchinson secured summary judgment in favor of an insurer in a declaratory judgment action arising out of whether the insurer owed a duty to defend its insureds and their teenage son under their homeowners and excess insurance policies. The claim and ensuing lawsuit (which alleged defamation, libel per se, malice in fact, invasion of privacy, intentional infliction of emotional distress, and negligent infliction of emotional distress), arose out of lewd and sexual images of the Plaintiff (a minor) that the insureds minor son allegedly sent throughout the school). The Court granted summary judgment primarily basing its holding on the policy’s criminal acts exclusion.
