Danielle Schwartz recently received a defense verdict in a Pennsylvania case involving a claim for property damage. Danielle’s client and the plaintiff were in a motor vehicle accident, after which Plaintiff’s vehicle was deemed a total loss. Accordingly, Plaintiff’s insurer paid Plaintiff for the actual cash value of her vehicle. Plaintiff then sued Danielle’s client seeking reimbursement for various vehicle add-ons and services she purchased along with the car. At the hearing, Danielle established on cross-examination that everything Plaintiff was seeking reimbursement for would have been included in the actual cash value payment she’d already received. By the end, Plaintiff conceded that she received a “pretty fair payment” from her insurer. The judge entered judgment in favor of the defense.
