Marc Aoun and John Morgan Win Total Denial of Claim and Penalty Petitions

TTH attorneys Marc Aoun and John Morgan successfully defended a Claim Petition recently before an Allentown Workers’ Compensation Judge, winning a complete dismissal of the claim. The Claimant alleged that his left middle finger was crushed by an industrial press. Through Marc’s meticulous cross examination and presentation of evidence, the Claimant’s story quickly unraveled. The Claimant changed his testimony twice regarding the date of injury after time sheets proved he was not working. Marc also highlighted the Claimant’s shifting description of the alleged mechanism of injury, showing that he told a healthcare provider that he merely struck his finger on a machine. Marc presented emergency room records showing that the Claimant had contemporaneously reported bilateral hand complaints for the past 3 months – predating his first day of work for the Employer. In the brief, John crafted a compelling narrative showing how the Claimant’s story changed each time the evidence disproved it. These arguments and facts ultimately convinced the WCJ that the Claimant lacked any credibility, resulting in a complete denial of the Claim and Penalty Petitions.
