Cases representative of his practice include:

  • Obtaining summary judgment for the owner and construction manager in a construction accident death case, Farabaugh v. PA Turnpike Commission, that reached the Pennsylvania Supreme Court. The Court affirmed summary judgment for the owner and, for the first time, outlined the duties a construction manager owes to employees of contractors on a construction site.
  • Serving as defense co-counsel in the groundbreaking case of Duchess v. Langston, wherein, for the first time, the Pennsylvania Supreme Court addressed the admissibility of subsequent remedial measures/design changes in product liability cases.

Overview

Mr. Newman’s diverse civil litigation practice is focused on product liability, construction site accident claims, construction defect claims, premises liability and commercial litigation. A large portion of Mr. Newman’s practice is devoted to defending cases that involve catastrophic injury.

He has aggressively and successfully defended many product liability cases in various state and federal courts, representing sellers and manufacturers of all types of products, ranging from industrial machinery to consumer goods. Mr. Newman has also defended numerous owners, contractors, subcontractors, engineers and construction managers with respect to construction defect and construction site accident claims.
