Pittsburgh TTH Attorney Sarah Cobbs Wins Unanimous Defense Verdict in Premises Liability Trial

TTH Attorney Sarah Cobbs recently obtained a unanimous defense verdict following a three day premises liability trial in Wilmington County, Delaware.  Plaintiff alleged that she tripped over a loose board on the porch of the house that she was renting.  Plaintiff filed suit against her landlord, alleging that he knew or should have known about the raised board and failed to maintain the property in a safe condition pursuant to the Delaware Landlord-Tenant Code.  Plaintiff’s demand was $1,000,000.00.

As a result of the fall, Plaintiff sustained fractures to both ankles.  She also alleged permanent impairment to her ability to walk.  Attorney Cobbs successfully argued that Plaintiff’s fall was not caused by any condition of the property, but rather, was caused by Plaintiff missing a step and falling.  The jury agreed and found that the Defendants were not negligent.
