Attorney Randy Burch received affirmance from the Superior Court on a trial court order granting summary judgment. The case stemmed from a house fire allegedly caused by the improper installation of a new heating system in the house. The insurer paid the homeowner over $500,000 to cover the loss of the home, personal property and living expenses. The insurer brought a subrogation action against the HVAC company which was settled in exchange for a general release. Homeowner then sued for damages allegedly not covered in her insurance payment, including claims for personal injury. The motion for summary judgment was granted based on a lack of evidence to support the claims of damages outside those in the release and subsequently affirmed by the Superior Court.
