TTH Attorney Amanda Hennessey recently won a Dauphin County arbitration involving a bathtub slip and fall at a local hotel. Plaintiff, represented by Morgan & Morgan, claimed that the hotel’s bathtub was unreasonably slippery because it did not have any anti-slip material or a bathmat, which caused Plaintiff to slip and fall. Plaintiff suffered fractures of the third and fourth right metacarpal shaft because of the fall. At the time, Plaintiff was in his senior year of his college track season. He claimed that the injury kept him from participating in certain track events and meets.
Amanda’s client argued that the bathtub was not unreasonably slippery as it had an anti-slip material installed at the time of the fall. An expert report was produced in support of that argument. The matter ultimately proceeded to arbitration and the panel entered an award the same day, finding that Amanda’s client was not negligent, and that Plaintiff was not entitled to any damages.
