In December 2025, TTH Attorney Alex Mitchell won a defense verdict for a master plumber and his plumbing company in a breach of contract lawsuit filed in Frederick County District Court. The matter arose from a verbal contract between Plaintiff and Alex’s client concerning a failed sewage pump. After assessing the sewage pump issues, Alex’s client advised the Plaintiff that his existing sewage pump was insufficient for its purposes. The Plaintiff was told he could replace the existing pump with one of like-kind, but doing so would be a temporary fix. Plaintiff agreed. The new pump initially worked, but as Alex’s client had predicted, the pump eventually failed again.
Plaintiff filed a breach of contract action for the value of the contract. During trial, Plaintiff argued that Alex’s client was hired to “fix his plumbing issues,” but instead, installed an insufficient pump, causing repeated failures. Plaintiff further argued that because Alex’s client did not fix the pump after it failed, he breached the verbal agreement. Plaintiff did not offer evidence regarding terms of the verbal contract. Specifically, there was no evidence of contract terms pertaining to a specific sewage pump that Alex’s client was to install. Plaintiff also failed to present any expert opinion or other evidence that the pump Alex’s client installed was insufficient. Alex argued that the Plaintiff failed to meet his burden of proof and the Judge agreed, entering a defense verdict against the Plaintiff.
