TTH Attorney Gabrielle Martin recently won a defense verdict in a Lehigh County Magisterial District Justice action. Gabrielle’s client was a residential landlord who commenced eviction proceedings against certain tenants. The tenants then counter-sued the landlord, asserting claims for unlawful eviction, harassment, and uninhabitable conditions. During the hearing, Gabrielle was able to elicit testimony that the tenants were still residing at the property, and that their Counterclaim against the landlord was filed merely in retaliation to the eviction proceedings. Based on this testimony, the Judge dismissed the Counterclaim on the spot and ruled in favor of Gabrielle’s client.
