TT&H Attorney Mike Bliley Wins Dismissal of Claim For Neck Injury and Cervical Fusion Surgery

Mike Bliley, who leads TT&H’s Virginia Workers’ Compensation practice from the firm’s Fairfax office, prevailed on a claim of lifetime medical benefits for an alleged neck injury, including a cervical fusion surgery.

Claimant fell on her side, injuring her shoulder. She later claimed that she also injured her neck in the same fall, and underwent a C5-C7 surgical fusion. Despite the fact that the treating physician recommended the cervical fusion and found it was related to the accident, the Deputy Commissioner accepted Mike’s argument that the neck issues were not causally related to the accident. The cost of the surgery alone approached $300,000, and Claimant’s most recent settlement demand before the hearing was $430,000.
