Washington, DC TTH Attorney Joanne Lee Wins Summary Judgment in Premises Liability Action

TTH Attorney Joanne Lee recently won summary judgment in the Superior Court for the District of Columbia.  In the suit, the Plaintiff alleged that she sustained bodily injuries after falling over an improperly installed water meter cover, which was situated in a grassy area between a sidewalk and a street.  The Plaintiff claimed that she fell because Joanne’s client replaced the water meter cover improperly, failed to warn the public about the condition, or otherwise maintained the meter and surrounding area in an improper fashion.  Joanne argued that her client had no duty to maintain the water meter cover and lacked notice of any dangerous condition.  She further argued that Plaintiff’s claim was barred by the public duty doctrine.  In granting Joanne’s Motion for summary judgment, the Court agreed that her client did not owe a duty to maintain the water meter cover, and that there was no evidence indicating that her client replaced the cover incorrectly.
