Thomas, Thomas & Hafer Attorney Amanda Hennessey Wins Summary Judgment on Slip and Fall Action

TTH Attorney Amanda Hennessey recently won summary judgment in connection with a York County premises liability action. The case arose from an alleged slip and fall in the restroom of a restaurant. Plaintiff walked into the restroom and went into the first stall. When Plaintiff exited the restroom stall, she noticed a puddle of water on the floor from the door to the sink. After she exited the stall, she walked over to the sink to wash her hands and allegedly slipped and fell. There were no wet floor signs present at the time of the fall.
Amanda argued that the restaurant did not have a duty to protect Plaintiff from a known and obvious condition on the restroom floor. Even if Plaintiff did not know that the water on the floor could be dangerous and cause her to slip and fall, it could be assumed, as a matter of law, that Plaintiff appreciated or should have appreciated the probability and gravity of the potential harm. Persuaded by Amanda’s arguments, the York County Court granted her Motion and entered summary judgment in favor of her client.
