Thomas, Thomas & Hafer Attorneys Jim Tinnyo and Taryn Vender Secure a Win on a Termination Petition

TTH Attorneys Jim Tinnyo and Taryn Vender were recently successful before a Pottsville Workers’ Compensation Judge on a Termination Petition. This matter originally began in August 2020. Pursuant to a prior Decision and Order before a WCJ in 2023, Claimant was awarded indemnity benefits until there was a change in Claimant’s condition. An IME done in 2024 deemed Claimant to be fully recovered from the accepted work injury and required no restrictions. Therefore, Attorneys Tinnyo and Vender filed a Termination Petition.
Attorney Tinnyo presented expert medical testimony that demonstrated Claimant had no objective basis for any of her subjective complaints, but rather exhibited symptom magnification. From a thorough review of the medical records, Attorney Vender determined that Claimant’s treating physician / medical expert had not physically examined Claimant in over two years, which Jim confirmed during cross-examination of Claimant’s witness. The WCJ agreed with Jim and Taryn’s position and issued a favorable Decision and Order for the Client, terminating Claimant’s benefits. The WCJ adopted many of the legal arguments made by Jim and Taryn in deciding this matter.
