Insurance Coverage & Bad Faith

Overview

TTH has long been a trusted legal partner to the insurance industry, representing national, regional, and local carriers in all areas of insurance coverage and extra-contractual matters. Our attorneys bring deep experience and practical insight to help insurers manage risk, resolve disputes, and navigate complex legal and regulatory challenges across all major lines of insurance.

We assist insurers with policy interpretation, drafting, and comprehensive coverage analysis. Our team routinely advises on claim handling practices, coverage investigations, and the preparation of reservation of rights and denial letters. We provide strategic counsel on risk transfer issues, including the obligations of additional insureds, indemnity provisions, and the prioritization of coverage among primary, excess, and umbrella carriers. Our work encompasses all major policy types, including commercial general liability, property and business interruption, professional liability, directors and officers liability, automobile liability and uninsured/underinsured motorist coverage, workers’ compensation and employers’ liability, as well as cyber, environmental, and other specialty lines.

TTH regularly handles complex, multi-party coverage litigation involving construction defects, catastrophic property losses, environmental contamination, intellectual property claims, personal injury, and allegations of fraud or material misrepresentation. We represent insurers in declaratory judgment actions, allocation and contribution disputes, subrogation claims, and matters involving policy rescission or reformation, in both state and federal courts.

A core strength of our practice is defending insurers in bad faith, unfair claims handling, and extra-contractual liability litigation. We have extensive experience representing insurers accused of wrongful denial of coverage, failure to settle within policy limits, delayed investigations or payments, and other alleged claims handling violations. We understand the significant reputational and financial risks associated with bad faith litigation and provide a vigorous, strategic defense designed to protect our clients’ interests at every stage—from pre-suit evaluations through trial and appeal. Our attorneys also advise insurers on regulatory compliance, litigation avoidance, and best practices to minimize exposure to bad faith claims.

At TTH, the Insurance Coverage & Bad Faith Practice Group is committed to delivering responsive service, practical guidance, and strong advocacy to support insurers in achieving favorable outcomes and maintaining the integrity of the claims process.
